US will not argue fiduciary duty in Bogucki case

Judge orders the issue is irrelevant and the US cannot attempt to prove its case on that theory

US DoJ says it will not allege at trial that Robert Bogucki was HP’s fiduciary in the legal and traditional sense

The US Department of Justice will not argue at Robert Bogucki’s upcoming trial that the former senior Barclays banker owed a fiduciary duty to Hewlett-Packard during the multibillion-dollar transaction in which he is accused of committing fraud.

California Judge Charles Breyer ordered on December 6 that the matter was irrelevant to the government’s criminal case, granting the defence’s motion to bar the US from arguing such a duty existed during the £6 billion currency options unwind conducted
